1. About Us

Australian CBD Oil Chemist (“we”, “our”, “us”) is a trading name of a private limited company registered in England and Wales.
Registered office: 68 Tanners Drive, Blakelands, Milton Keynes, MK14 5BP, United Kingdom.

2. Acceptance of These Terms

By accessing australiancbdoilchemist.com (the “Site”) or placing an order, you confirm that you have read, understood and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Site.

3. Eligibility & Age Restriction

You must be 18 years or older and have legal capacity to enter binding contracts. We may perform age‑verification checks and reserve the right to cancel any order that fails verification.

4. CBD Product Compliance & Disclaimer

Products are derived from EU‑approved industrial hemp and contain ≤ 0.2 % THC, compliant with the Misuse of Drugs Act 1971 and current UK Home Office guidance.
Products are food supplements and not medicinal products. They are not intended to diagnose, treat, cure or prevent disease. Seek medical advice before use, especially if pregnant, breastfeeding, taking medication or under medical supervision.
Keep products out of reach of children.
You are responsible for ensuring that possession and use of CBD products is legal in your jurisdiction outside the UK.
Certificates of Analysis are available on request.

5. Placing an Order

Your order constitutes an offer to purchase. An acknowledgement email is not acceptance; acceptance occurs when goods are dispatched. We may refuse or cancel any order at our discretion.

6. Prices, Currency & Payment

Prices may display in local currency for convenience but are processed in pounds sterling (GBP). Your card issuer may apply conversion fees.
Charges on your statement will appear as PIX*Australianchemist
Prices include applicable UK VAT unless stated otherwise.
Payment is taken in full when the order is placed using the methods shown at checkout.

7. Shipping, Risk & Title

Shipping destinations, options and estimated delivery times are set out in our Shipping Policy (which forms part of these Terms). Risk passes to you on delivery; title passes once full payment is received.

8. Cancellation, Returns & Refunds

Goods must be unopened and in a resalable condition. Return postage is at your cost unless items are faulty.
Refunds are issued within 14 days of our receipt of the returned goods.

9. Promotions & Discount Codes

Promotions are subject to availability and may be withdrawn without notice. Discount codes are non‑transferable, have no cash value, and must be entered at checkout.

10. Intellectual Property

All content on the Site—logos, text, graphics, images, software—is owned by or licensed to us and protected by intellectual‑property laws. You may not copy, reproduce or exploit any part without prior written consent.

11. Prohibited Uses

You agree not to misuse the Site or products, including but not limited to: unlawful purposes; solicitation of unlawful acts; violation of regulations; infringement of IP rights; uploading malicious code; harvesting personal data; or interfering with security features.

12. Data Protection & Marketing (GDPR)

Data Collected: name, address, email, telephone, payment details, browsing behaviour.
Lawful Bases: contract (order processing), legal obligation (record‑keeping), consent (marketing), legitimate interests (fraud prevention, Site optimisation).
Marketing: sent only with opt‑in consent; opt‑out anytime via “unsubscribe” or by contacting us.
Data Sharing: limited to service providers under GDPR‑compliant agreements; we never sell personal data.
Your Rights: access, rectification, erasure, restriction, portability, objection, and complaint to the UK ICO.
Retention: personal data kept only as long as necessary.

13. Limitation of Liability

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be limited. Subject thereto:

- Our aggregate liability for a claim shall not exceed the price paid for the order giving rise to the claim.
- We are not liable for (a) loss of profits, revenue, business, savings or data; (b) business interruption; (c) indirect or consequential loss.
- We make no warranties, express or implied, regarding uninterrupted or error‑free operation of the Site.

14. Indemnity

You agree to indemnify, defend and hold harmless Australian Chemist, its directors, employees and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or violation of any law or third‑party rights.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations where the delay or failure results from events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, supply shortages or governmental action.

16. Changes to These Terms

We may modify these Terms at any time. Updated versions will be posted on this page with a revised “Last updated” date. Continued use of the Site constitutes acceptance of the amended Terms.

17. Governing Law & Dispute Resolution

These Terms and any purchase contract are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to resolve any dispute or claim.

18. Alternative Dispute Resolution

Consumers may submit complaints via the European Commission Online Dispute Resolution platform, without affecting the parties’ right to litigate in the courts of England and Wales.

19. Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

20. Waiver

Failure to enforce any provision shall not constitute a waiver of that provision or any other.
